1. Scope and Parties

These Terms and Conditions (“T&C”) apply, without restriction or reservation, to all sales of products (“Products”) marketed by Marcel Robert SAS (“Marcel Robert”) to consumers and non-professional buyers (“Client(s)”) on the website marcel-robert.com (the “Site”). By placing an order on the Site, the Client acknowledges having read and accepted these T&C. The applicable version is the one in force on the Site on the date of the order. Unless proven otherwise, data recorded in Marcel Robert’s IT systems constitutes proof of all transactions concluded with the Client.

 

2. Products

Products offered for sale are those displayed on the Site on the day of consultation. Each product page includes essential characteristics, photos, available colors, composition and, where applicable, specific features. Minor differences may exist between the Product and its photo (screen settings, color rendering, etc.). See our current collections here: all products.

 

3. Prices

Prices are indicated on each product page in the currency displayed on the Site and inclusive of applicable taxes. Shipping fees are charged in addition and are shown before order validation. Some countries outside the European Union require duties and taxes to be paid upon delivery; where applicable, these are borne by the Client and are disclosed during checkout for full transparency. Risk of loss and damage transfers to the Client after delivery.

 

4. Orders and Payment

4.1 Placing an Order

The Client selects the desired Product(s), adds them to the cart, reviews the cart, and proceeds through checkout. If applicable, a valid promotion code must be entered in the dedicated field before payment.

4.2 Order Confirmation

Once payment is accepted, the Client receives an email confirmation summarizing the order (items, billing and shipping addresses). This confirmation and payment acceptance form a sales contract between the Parties. In case of legitimate reasons (abnormal claims/returns, unusual quantities, existing dispute, stock error), Marcel Robert may decline an order.

4.3 Payment

Payment is due in full at checkout by bank card (Visa, Mastercard, American Express, Maestro), supported wallets, or PayPal. Transactions are secured via SSL and processed by Shopify’s payment partner. At no time do the Client’s banking details transit through Marcel Robert’s own systems. More details: payment page.

4.4 Archiving

Order confirmations are stored on a reliable and durable medium and serve as evidence of the contractual relationship.

 

5. Delivery

Orders are shipped with reliable carriers such as Colissimo, Delivengo or DHL, depending on destination and option chosen. Indicative transit times: 2–5 business days within France and 3–15 business days internationally. These times are indicative and may vary. A tracking link is sent upon dispatch. If the indicated delivery time is exceeded by more than ten (10) days for reasons other than force majeure, the Client may request cancellation and a refund of amounts paid, within fourteen (14) days of Marcel Robert’s written acknowledgment.

If an item becomes unavailable after order confirmation, the Client will be notified within 24 hours and offered an extension of the initial delivery time; if refused, the order will be cancelled and refunded without delay. For non-EU deliveries, duties/taxes may be due on delivery (borne by the Client).

 

6. Receipt – Claims – Returns

6.1 Receipt

Upon delivery, the Client must check Product conformity. Any anomaly (opened/damaged parcel, missing or damaged items, non-conformity) should be noted with the carrier and notified to Customer Service within the legal time limits:

6.2 Statutory Warranties

Products benefit from the statutory legal guarantee of conformity for one (1) year from delivery, as well as the warranty against hidden defects. These legal warranties apply independently of any commercial warranty that might be offered.

6.3 Returns of Non-Conforming Products

The Client must submit a return request from their account (“My orders”) and include the delivery note in the parcel. Items must be returned in the original packaging (or equivalent protective packaging), with tags and any accessories, to the address above.

Return shipping is complimentary for orders shipped within mainland France. For international orders, return shipping is payable by the Client. Once non-conformity is confirmed, Marcel Robert will refund the order price (Products and original shipping) and the reasonable return shipping costs within fourteen (14) days of confirmation by Customer Service. Taxes/duties paid upon import are excluded from refunds. COD returns are not accepted.

7. Right of Withdrawal

The Client has fourteen (14) calendar days from receipt of the order to exercise the right of withdrawal by notifying Marcel Robert at the email/postal address above. Return shipping is complimentary within mainland France and payable by the Client for international orders.

Subject to the above, Marcel Robert refunds the Product price (including VAT) excluding original shipping and return costs, within fourteen (14) days from receipt of returned Products. Exceptions: customized or made-to-order items are not eligible for withdrawal. See: /pages/returns.

 

8. After-Sales Service

For repairs or exchanges (including those related to legal warranties), contact: contact@marcel-robert.com with photos and proof of purchase. If a manufacturing defect is confirmed, the item will be repaired free of charge or replaced with an equivalent new item. Out-of-warranty repairs are subject to a quote. Contact page: contact us.

 

9. Intellectual Property

All elements of the Site (brand, logo, domain name, models, photographs, animations, texts, descriptions and, more broadly, all visual or audiovisual content) are protected by intellectual property laws. Any reproduction, representation, modification, publication, transmission or adaptation, in whole or in part, on any medium and by any means, without prior written authorization from Marcel Robert, is prohibited. 10. Liability

Marcel Robert undertakes to properly perform the obligations arising from the sales contract. However, it cannot be held liable in the event of non-performance attributable to the Client, to an unforeseeable and insurmountable act of a third party, or to force majeure. Access to the Site may be suspended without notice for maintenance, updates or security reasons.

 

11. Force Majeure

If a force majeure event prevents total or partial performance of obligations, Marcel Robert will inform the Client. If the event continues for more than one (1) month, the order will be cancelled and refunded to the original payment method within thirty (30) days.

 

12. Governing Law – Disputes

These T&C are governed by French law. In case of dispute, the Parties will first seek an amicable solution. Failing that, the competent court will have jurisdiction. The Client may also use the European online dispute resolution platform: https://ec.europa.eu/consumers/odr.
